Terms of Service
By using our website, you agree that you have read our terms of service (hereafter referred to as “terms” or “terms of service”) and agree to comply with the terms herein. This is a legally binding agreement between you and Probate Seller Leads and Training LLC (hereafter referred to as “our,” “we,” “us”) and any of its subsidiaries. Please consult your attorney before agreeing to these terms.
We reserve the right to modify these terms at any time, for any reason, and without notice. As a courtesy, we may notify you via email of any changes made to these terms, but you should not rely on receipt of an email notification. You agree that we may notify you of the updated terms by posting them on the website and/or by sending an email to the email address provided by you at the time of registration. If you opt-out of receiving emails from us, we are not responsible if you are unaware of any changes to these terms. Your continued use of our website constitutes your agreement to the updated terms. These terms supersede and replace all prior terms of service.

Age Requirements
By using our website, you attest that you are at least 18 years of age and can enter into a legally binding agreement.
Applicable Law
You agree that the laws of the State of Arizona will apply to these terms and any dispute that may arise between you and Probate Seller Leads and Training LLC or any of its subsidiaries.
Subscriptions
The following applies to all pricing plans:
We reserve the right to accept or reject the purchase of any of our products or services at our sole discretion.
We reserve the right to change the price of our products or services at any time and will provide you a minimum of a 30-day notice via email. The new price will be billed on your next billing date after 30 days has passed since you received the notice.
You will be billed immediately upon purchase, either at the monthly pricing plan rate or the lump sum for a pricing plan that is billed semi-annually or annually, whichever you selected at the time of purchase. When subscribing to our service, you are not required to enter into a contract or commitment to continue the service. You can cancel your subscription at any time by sending an email to support@probatesellerleads.com. You must submit your request for cancellation no later than 7 calendar days prior to your next billing date to avoid being charged again. You can view your next billing date from the dashboard when you are logged into the website.
If the transaction for the payment of your subscription is not approved, your subscription will be immediately cancelled and access to your website dashboard will be suspended or revoked.
We reserve the right to terminate your subscription and suspend or revoke access to your website dashboard, and any data or content contained therein, at any time, for any reason, at our sole discretion and without notice.
You will no longer be billed if your account is terminated at our discretion, and you will not be given a refund of any charges that occurred prior to termination.
Your subscription will automatically renew until it is cancelled or terminated.
Refunds
Refunds will not be provided in whole or in part under any circumstances unless decided at our sole discretion. Prorated refunds will not be provided for subscriptions that require an annual or semi-annual lump sum payment whereby a customer cancels their subscription prior to its renewal date. Refunds will not be provided if your account is terminated by us unless decided otherwise at our sole discretion.
If you purchase our training course as a stand-alone product, you are entitled to get the cost of the course credited towards the cost of your leads subscription if you decide to subscribe at any time after purchasing the training course. This credit will be applied automatically and in its entirety to your first billing charge for your leads subscription.
Joining EXP Realty LLC
EXP Realty LLC makes no guarantees or claims to customers of Probate Seller Leads and Training LLC and is not at all associated with Probate Seller Leads and Training LLC.
Joining EXP Realty LLC is not a requirement for purchase of our products or services. We offer a discounted subscription price to real estate agents who join EXP Realty LLC with Dominick Cole named as their sponsor, provided that the real estate agent meets the requirements outlined here <link to the “Requirements” page>. We will provide or deny said discount at our sole discretion.
We are not responsible for any loss or expense incurred by you joining EXP Realty LLC, either now or if our products or services are discontinued for any reason, including account termination, account cancellation, or dissolution of Probate Seller Leads and Training LLC.
Discounted subscriptions for customers who join EXP Realty LLC with Dominick Cole named as their sponsor will only receive this discount while they are licensed with EXP Realty LLC and their subscription will automatically adjust to the current monthly pricing plan upon disassociation with EXP Realty LLC and will be billed accordingly. If Dominick Cole disassociates from EXP Realty LLC for any reason, this discount will cease, and your subscription will automatically adjust to the current monthly pricing plan and will be billed accordingly, unless decided otherwise at our sole discretion.
If your gross commission income, less any referral fees to other real estate agents and companies, at the end of your anniversary year after joining EXP Realty LLC, with Dominick Cole named as your sponsor, is below the minimum required to receive the stated discount, your discount will be adjusted to the next discount bracket, based on what your commission income was for that previous anniversary year, and shall remain in place until the end of the following anniversary year, at which point it may be adjusted again depending on your gross commission income at that time. These adjustments will be made at our sole discretion. We may request supporting documentation from you at any time to substantiate your commission income, your team roster, as well as your team members commission incomes, if applicable.
Account Registration and Usage
You hereby agree that you will provide accurate information when creating your account and that you will update it whenever there are any changes to the requested personal information. It is your responsibility to maintain the security and access to your account. If you suspect that your account has been compromised, please notify us immediately. If we incur any damages or loss due to your negligence in securing your account and/or by not notifying us immediately of your account being potentially compromised, you may be held legally liable.
Use of Data and Informational Content
You understand and agree that all data and information provided by us is for informational purposes only and is not to be taken as legal, tax, or financial advice. We make no claims or guarantees as to the accuracy of the data and information, nor to any specific results you can expect to achieve by using the data and information. Your results will depend on the effort you invest in learning and implementing our training, in addition to variables that are beyond our control.
Your use of our data or information is entirely at your own risk. It is your responsibility to check the provided phone numbers to determine if the phone numbers are on the do-not-call registry, if that is important to you, and to abide by any applicable state or federal laws as it pertains to telemarketing or email marketing, whether we made any indication that a phone number was on the do-not-call registry or not.
We intend to provide you with a new batch of leads twice per month. However, we do not guarantee delivery of a specific number of leads since it varies based on the number of probate cases that are filed in a given timeframe. We do not guarantee delivery of leads on an exact date or in an exact interval since there may be delays that occur in procuring and curating the data. Additionally, we do not guarantee delivery of training information on an exact date or interval. If for whatever reason we are unable to provide probate leads for a period that exceeds 30 days from your last billing date, including due to the website not being available for any reason, we will notify you and provide options on how we can proceed with your subscription, such as by pausing the subscription until we are able to provide the leads as expected, for example.
All data and information on our website and within any material that we provide is the property of Probate Seller Leads and Training LLC and its subsidiaries and is protected by copyright law. Any unauthorized use of our website or data may result in legal action. This data and information cannot be reproduced, redistributed, sold, or published in any way without our written consent, with exception to downloading the probate lead data for the sole purpose of importing it into a third-party contact management system or to use the data manually. It is prohibited to commercially exploit the content in any manner without our written consent. It is prohibited to share the data and/or information with members of your staff, team, or independent contractors with whom you do business if it was not disclosed to us either at the time of purchase or in writing thereafter and you received our consent. Such disclosure may result in the changing of your pricing plan by mutual agreement; otherwise your subscription will be terminated.
You agree that you will not use the data and information in any unlawful way and to comply with any reasonable requests made by us to protect the integrity of the data and information. You agree to not remove any copyright or trademark notices or logos from our data and information.
All links and references to other websites or companies who are not an affiliate or subsidiary to Probate Seller Leads and Training LLC are provided for informational purposes only and are not to be taken as a direct recommendation or endorsement of that company or their product or service. Furthermore, you understand that Probate Seller Leads and Training LLC may have an affiliate marketing relationship with said companies and may receive compensation from them as such.
Disputes
In the event of a dispute, prior to initiating litigation, you agree to negotiate directly with Probate Seller Leads and Training LLC. If the dispute remains unresolved after negotiation, you agree to mediation with a mediator that is mutually selected. If the dispute remains unresolved after mediation, you agree to binding arbitration.
Any dispute between you and Probate Seller Leads and Training LLC or its subsidiaries will be subject to the laws of the State of Arizona, and you agree to exclusive jurisdiction in Arizona. You also agree that the maximum liability for damages is equivalent to the total amount paid for your subscription in the most recent calendar year.
Indemnification
You agree to indemnify and hold harmless Probate Seller Leads and Training LLC, its subsidiaries, and its and their respective successors, assigns, directors, officers, employees, agents, stockholders, and affiliates from and against all claims, demands, actions, suits, damages, liabilities, losses, settlements, judgments, costs, and expenses [of or by a third party OR whether or not involving a claim by a third party], including but not limited to reasonable attorneys’ fees and costs, actually or allegedly, directly or indirectly, arising out of or related to (1) any breach of any representation or warranty of Probate Seller Leads and Training LLC contained in this Agreement; (2) any breach or violation of any covenant or other obligation or duty of Probate Seller Leads and Training LLC under this agreement or under applicable law; (3) any third-party claims which arise out of, relate to or result from any act or omission of Probate Seller Leads and Training LLC; (4) other enumerated categories of claims and losses, in each case whether or not caused in whole or in part by the negligence of Probate Seller Leads and Training LLC or any other indemnified party, and whether or not the claim has merit; and (5) your use or misuse of data or information provided to you by Probate Seller Leads and Training LLC or its subsidiaries.
